EU Drone Regulation

General no-fly zones
Specific Information
In Spain, commercial drone flights are regulated extremely strictly and restrictively, with extensive requirements and limitations. Violations of current drone laws can result in fines of up to 225,000 euros. Clear and limited use scenarios exist within which a drone may be used commercially. These include areas such as research and development, broadcasting, advertising, television, and environmental observations such as monitoring forest fires or surveying.
Private recreational use of drones in Spain is classified as "aero model" or model aircraft and is therefore not subject to the strict regulations for commercial drone flights mentioned above. The Royal Spanish Aeronautical Federation (AESA) is responsible for regulation. No separate approval, registration or authorization from AESA is required for private use as an "Aero Model".
In the case of private drone use in Spain, including during vacation, the following simplified specifications, rules and laws apply:
- Flights may only be made within visual range.
- Flight altitude is limited to 120 meters.
- Flights are not allowed in cities or urban areas.
- Flights are not allowed over people or crowds (including beaches, concerts, parks, demonstrations, etc.).
- Night flights are prohibited.
- The drone operator must have safe control of the aircraft.
- Flights are prohibited near airfields or airports, and in areas with low-flying aircraft or other aircraft.
- Although specific drone insurance or liability insurance is not required by law in Spain, it is strongly recommended to have such insurance that also covers Spain as a vacation or foreign destination.[2]

Drones under 250 grams may fly over buildings and people (but in no case over crowds) with a maximum height of 20 meters as long as the pilot has visual contact with the drone.[3]
